In the end it doesn't really matter that much. There is (at least) one "unlawfull" point in the policy which renders the policy quite useless And besides that, even without a policy, MRC has the right to ban people and just "do what they damn well please". It's their site, and that's it Use it if you like... and if you don't, please feel free to set up your own one
And for the rest, I don't see any lawsuits comming here in this MSX-land, although GuyveR800 threatens with it now and then (still waiting here!!!) So is it all really needed? Nah....
And even judges normally use common sence (if it would ever come down to that)

Actually, we've had to remove content before, and in my opinion that's a shame. While we've never had to remove any critical content, it did get us thinking about how we could prevent the possible loss of content in the future. The current policies at least give us something to argue if it ever were to come to a lawsuit. Right now we have a reasonably solid base to deny any future requests for content removal, which was exactly what these policies were about.

Quote:

These are the parts of the policies I find not acceptable at all:

That's probably because you don't interpret the legal mumbo-jumbo correctly...

Quote:

You also declare to periodically check the policies for changes

This means you don't get to say "Oh, I didn't know I couldn't post my Konami warez collection on the forum?!? You sure that was in the policies? It wasn't last time I checked!" This is the basic principle of any legal system by the way. Every citizen (of age) of every country is obliged to know the laws of that country (all 1743 volumes of 'em) and is obliged to have knowledge of any new laws passed. You don't get to say "I didn't know that was illegal".

Quote:

1.4 By disagreeing with this agreement/these policies you agree to cease using the MRC and its services immediately. This policy will stay in effect, even if you disagree with the terms of the agreement. Disagreeing with the agreement/these policies does not grant you any rights to violate the rulings of these policies.

Also fairly standard. This means that the rules still apply if you don't agree with them. So no "I'm sorry Mr. Judge, but I don't agree with that whole Murder being Illegal thing, so I won't be going to jail..."

Quote:

2.4 MRC preserves the right not to publish submitted content or to alter the distribution package of the submitted content, before or after publication, without prior consent.

This means we have the right not to publish the pictures of someone's naked grandma if those are submitted. I hope you agree with this rule. It also means that if we do decide to publish those pictures we get to package them in a ZIPped .dsk file, even if the original was sent to us in a PMA file.

Quote:

3.2 MRC does not claim any copyrights to user submitted content. In accordance with 2.1 however, MRC may publish submitted content, without limitation, at its own discretion, in any form available

This means that MRC does not claim copyright to any work you submit (meaning you're still the owner), but that we do get to distribute it (as in it stays on the site) once you decide to submit it.

Quote:

Like in a real democracy we have a choice. I find the policies of the MRC so agressive that I will never post any file or a topic with any value on the MRC.

Indeed, you do have a choice. You can at all times choose not to submit anything to MRC. This ensures we won't have it available for download for anyone.

Quote:

The policies tell me the MRC can do anything they want with my material and they can change the policies without warning (I will have to discover changes myself and I have already agreed to those just by reading it!) to whatever they like.

Actually, we don't get to do what we want with them. All we get to do is host the files for download.

Quote:

So I stick to reading and an occasional useless topic or pointer to free content, and stay that way within the policies. But they will never get any value from me in good trust, because the policies show they dont trust us.

It's a good thing you trust us though!

Quote:

There are better and applicable policies, like the Creative Commons in one of its variations.

I'm not sure Creative Commons is really the same as the Terms of Service policies we have here...

Anyhow, we're back to the nuff said part again, because (more than) enough has been said about this. Just check every website you regularly use, I'm sure you'll find 90% of those have policies very similar to those we have here...

Indeed, enough said. I do agree on your defensive policies to protect the integrity of the MRC as fas as posts in the forum are concerned. It is the other content we do not really agree on. No problem, we live and let live, in peace out, of love for our MSX computers.

But again, we agree on one thing, enough said. The bad guys, and I do not mean you!, are picking up this polite discussion as an excuse to start their hate wars again. And that is not something I want to encourage or be part of. I want to say loud and clear I do not agree at all with and reject the intentions and actions of those persons.

Keep up the good work and ignore the bad!

I don't like to "choose sides", and I don't hate anyone in the MSX community but there's crap going on at msxposse and no matter how I look at it it's all just very laughable.

Igniting even more fuel between MRC <-> anti-MRC was not my intention when I started this discussion, I propose a topic lock before it gets even worse.

Topics are locked when there's yelling/trolling going on (doesn't happen too often -anymore!- luckily), sofar I've only seen a normal discussion without the ingredients we've seen in earlier locked threads. Hence, it'll remain open for normal/mature debate. Regarding the 'crap': ~2..5 people are entertaining themself (with them being their sole own audience). Let's not exaggerate, let's !

If one's bothered by the presence of this thread: best one can do is let this thread fade away into history, post new threads or replies in other threads and soon this one is no more than a distant memory..

You have no problem with this topic indirectly causing a new flamewar? It's not just one sided, someone on the MRC side threw in a silly insult to the beef.

This topic was about the policies which have been around a while already, nothing new here. On the other side, it's seen as a new opportunity to ignite a flamewar again. Today this topic, tomorrow another topic. It'll go on like this day after day, week after week, year after year. And as far as I can see, the 'silly insult' was posted on Posse, by a Posse user. Had it not been posted, we wouldn't have been talking about it.
