All games sold are a copy of the original/master program. So yeah, he want's a copy, as do I.

depends on who's doing the copying. If it's the author he can grant permission to copy the game to himself

Sorry, as I'm meddling in this topic anyway, I might add something which might actually contribute to the discussion.

If I'd have the talent to code something like this, damn, maybe I would have made quite a few 100% finished, ass-kicking games!
And who wouldn't love to make a sequel to a great Konami game?

Anyway, if Konami's stance about this project would be very disapproving (meaning: They will hire lawyers that live on raw human flesh), I'd just change the graphics/strory/everything and use those talents to create a really cool game anyway.
But I think I understand why those guys want to make a Space Manbow 2, and I wish them good luck with that.
