Ok, seen it now. Well, regarding the games, I guess there's not much for you to do. It's for some games -perhaps- more a Bazix case, even. But if you have a BlueMSX EULA somewhere in which you state that the end user can't sell BlueMSX then you have a case. Contacting ebay won't hurt I guess..  |

I noticed this one too. I think the only thing that you can do is contact ebay to remove it. Not sure if you have included anything about reselling the emulator in the license.

Well, trickery... but is Vampier's title one that came from the ebay ad? In case of a clash between dvik and the ebay user who placed the ad, the user may bring on that he wasn't selling BlueMSX, only the games, and that BlueMSX came as a free bonus. He may be assuming that selling an emulator is tricky, but that selling games is safe as they're all old aged games from long-gone companies.

Same here, it's a KPN problem (several other sites aren't working well either).
GPL allows software to be sold. If you try to stop the seller, he'll probably claim he's selling the CD + his effort for collecting the files+burning them on the CD. Selling those games and BIOS ROMs is illegal though, if you notify eBay, they'll most likely remove his auctions. |

You could send a Electronic Notice of Infringement to VERO at Ebay, but with only three hours left the auction will end before Ebay will respond. If you'd like to protect BlueMSX from being sold at Ebay you should register yourself with Ebay for the VeRO program as the IP owner of BlueMSX.

The auction seems to have ended now. Its not so much about distribution and sales of the emulator that I don't like but since Bazix stated their policy about distributing games (the msx mbox package for example) I don't want blueMSX to appear in these type of bundles.

I filed a complaint with ebay, it seems they closed all auctions. on top of that I sent the guy a nice little e-mail

FYI, it's completely legal and allowed by the license of blueMSX and C-BIOS to sell the software (in any form, except for the GPL parts of blueMSX which needs source code included, AFAIK), under the conditions of the BSD license. But it's of course not legal to sell the proprietary software that is included in the bundle.
Whether it is nice to do, is another question.
Anyway, sometimes it is. E.g., you can buy Debian cd's/dvd's and they may include openMSX and C-BIOS.

@manuel, its legal to grab the source code of blueMSX from the CVS, build it and distribute it. Its actually not legal to distribute the binary and all the support files for commercial use. They don't have GPL license. You can see the license agreement in the about dialog of the emulator.
