Why? From the Sourceforge page, it looks like BlueMSX is dual-licensed, one of which is the zlib/libpng license which allows commercial redistribution and modification. If the developers don’t want that they should pick a license that doesn’t permit that…

That said, I think the MSX community is a bit old-fashioned with regard to its open source practices, most people keep their code to themselves. At least I don’t know many open-source MSX projects.

A lot of people could probably learn from the code of the current MSX devs, especially when the code is even in a version control system so one can see how the code evolves.
But I believe I've mentioned this a couple of times before..

Most of blueMSX is under GPL (some under zlib as Grauw mentioned). Releasing (and selling) the emulator is perfectly fine as long as the GPL license is followed.

What I'm not particularly happy about is when someone use blueMSX in a bundle with illegal software as is the case here. But I'm not really sure what to do about it. Last time someone made a bundle they didn't follow the GPL license and I was quite hard with them and actually filed complaints of license violation to ebay which I hope ended in suspension of that user (that would be quite bad for him because he had accumulated very good seller feedback). But I really think its a misuse to sell the emulator on DVD's with illegal games.
