Assuming with 'some roms' you meant 'popular game roms' ? Hmm... would you want to be sued before release of your app, immediately after release, or years after release while you raked in loads of cash in the meanwhile? 
Combining 'illegal' with 'for profit' is asking for trouble, but be my guest. Btw: if such an app would be popular, who says you couldn't license those original ROMs? Wouldn't be the first oldie-wrapped-in-emulator-released-on-recent-platform...
Also is highly unlikely that Apple would approve it and place in the App Store. They recently banned a C64 emulator, BTW.
But hey, Android store is a different animal, they don't ban or approve software. But it is very probable that you got sued anyway!
Well, japanese roms would be impossible.
Maybe some Spanish roms...
remaking the game with the same gameplay and very similar, but a little different graphics, is less illegal?
