AFAIK it's not illegal to link to warez, but it is illegal to have warez for download. AFAIK it's a decision of MRC (in their policy) to ban links to warez. If you (tfh) consider blueMSX warez, it would be a violation of MRC's own policy and not a violation of the law. Apparently the MRC policy enforcement is a bit selective then.

That is very nice, but it's wrong. The MSX system ROMS ARE copyrighted, which technically make BlueMSX warez. Or can you tell me why OpenMSX doesn't include them? It's not a matter of opinion. Down to the letter of the law, any emulator with embedded roms is illegal. That is NOT my point of view.


About when Bazix takes actions: it seems they take action to sites that *host* warez, not sites that link to warez. But it seems they have overlooked the MSX-MBox that was still on the net. I think the reasons why they take on MSX-MBox was explained already in a way older (and painful) thread: http://www.msx.org/forumtopic4355p15.html (Especially read the posts by Rikusu, e.g. the one on page 2 and 10.) In short: we've already been through this.

Computer Idee, nor MSX Posse is hosting MSX box. They were both just linking to it indeed.

It's hard (perhaps impossible) to find a hole in tfh's reasoning. It's purely feelings that tell us that it's perfectly understandable that Bazix would do something against MSXMBox and not BlueMSX. I agree entirely with those feelings, but that doesn't make tfh's argument invalid.

Arf, how difficult it is to communicate through writing. Smile What I meant is not to say that the ROMs are not copyrighted (everything is copyrighted, unless the copyright-holder says he wants to get rid of the rights), but that it is not against the law to link to blueMSX from MRC, AFAIK. (See my first line.)

Anyway, if you're Bazix, and you don't like people to download/use MSX-MBOX, because it undermines your Woomb-plan, then I can imagine you wouldn't like to have links to it from ComputerIdee.nl, because (as the 175GB in 2 days proves) it would cause a huge lot amount of downloads compared to a link on some FTP site or on MSX-Posse, e.g.

IMHO, copyrighted and not copyrighted data should be separated somehow.
I just tried to download Arranger demo mp3s from Generation MSX, and - guess what ?
They were linked to nowadays wiped funet.

I also had some links to various pdfs there from my sites - all of them are broken now.

not really related to the legal/illegal issue, but I think sites in general shouldn't depend so much on linking as they sometimes do.

There's been lots of instances where I wanted to download something and dozens of sites would be linking to the same dead link. But anyways, that has hardly anything to do with legal issues....

In my case, I am using free hosting where I can put a very limited amount of data, and I cannot host those big pdfs locally.

Indeed, technically it's not 100% correct how we use the word copyrighted here, but most people know what we mean, so it's only a technicallity.

I get that, it was more a general statement...there's many cases where a site could host a mirror of some file but they link instead.
